The copyright in the information and the design of the system stored on this CD ROM/Web site (the software), whichever applicable, is owned by Rotork Controls Limited (the owners).  Instructions for use are included in the README file included with the software.


1.	LICENCE

1.1	You are permitted to load the software and use it on a computer that is owned by you.  You are also permitted to transfer the software from one computer to another.

1.2	You are permitted to use the software on any computer or system that permits electronic access to it by more than one user.

1.3	You are permitted to use the software only in accordance with the terms of the Agreement.

1.4	You are not permitted to rent, lease, sub-licence, copy, modify, adapt or create derivative works based on the whole or any part of the software or associated documentation.


2.	ACCEPTANCE

	You shall be deemed to have accepted the terms of this Agreement by loading the software into any computer.


3.	TERM

	This licence is effective until you terminate it by destroying the software and its documentation together with all copies.  It will also terminate if you fail to abide by this Agreement.  Upon termination you agree to destroy all copies of the software and its documentation including any software stored on the hard disk of any computer under your control.


4.	OWNERSHIP

	You only own the CD-ROM (or authorised replacement) on which the software is recorded.  You may retain CD-ROM on termination provided the software has been erased.  The owners shall at all times retain ownership of the software as recorded on the original CD-ROM and all subsequent copies thereof regardless of form.  This Agreement applies to the grant of the licence only.


5.	USE

	You may use the software to create CAD files onto any computer or system for the express purpose of creating documentation.  All design rights are retained by Rotork Controls Ltd.


6.	ASSIGNMENT

	Your rights and obligations set out in this licence may not be assigned or delegated without the Owners prior written consent.


7.	LIABILITY

7.1	The Owner warrants that the media on which the Software is supplied will be free from defects in materials and workmanship under normal use for a period of 30 days after the date of original purchase ("the Warranty Period"). If a defect in the media shall occur during the Warranty Period it may be returned with proof of purchase to the Owner who will replace it free of charge.

7.2	The above represent your sole remedies for any breach of the Owner's warranties, which are given only to the original user.

7.3 	Whilst the Owners have taken reasonable steps to ensure the accuracy of the information contained in or shown by the software, the Owners do not warrant that the software or any information contained in or shown by the software will meet your requirements or be error free or that the operation of the software will be uninterrupted or error free or that defects in the software will be corrected.  You shall load and use the software at your own risk and in no event will the owners be liable to you for any loss or damage of any kind (except personal injury or death resulting from the Owner's negligence) including lost profits or other consequential loss arising from your use of or inability to use the Software or from errors or deficiencies in it whether caused by negligence or otherwise except as expressly provided herein. In no event shall the Owner's liability exceed the amount paid by you for the Software.

7.4	It is your responsibility to check the software to our satisfaction against the presence of computer viruses.  Whilst the Owners have taken precautions to avoid the incorporation of any such virus, it is strongly recommended that you check the software with appropriate high quality virus-checking materials.  The Owners accept no responsibility for any loss, damage or expense of any kind arising from the presence of any such virus.

7.5	The express terms of this Agreement are in lieu of all warranties, conditions, undertakings, terms and obligations implied by statute, common law, trade usage, course of dealing or otherwise, all of which are hereby excluded to the fullest extent permitted by law.  This Agreement shall be governed by English law and the parties hereby submit to the exclusive jurisdiction of the High Court, London.
